1. Can I receive legal advice from the City Prosecutor’s Office?: No. The City Prosecutor does not represent individuals in private legal matters and cannot provide any legal advice to individuals. If you need help with a personal legal matter such as filing a lawsuit, creating a will, or defending against a criminal charge, you may want to contact a private attorney. If you do not know an attorney in your area, the State Bar of Arizona’s website provides information on attorney referral services for persons of varying income levels.

2. What kinds of cases does the San Luis City Prosecutor prosecute?

The City Prosecutor prosecutes criminal and traffic violations of Arizona Revised Statutes as well as violations of the San Luis Municipal Code including misdemeanors and civil infractions arising from traffic and non-traffic matters.

Felonies and most offenses committed by juveniles within the City of San Luis are prosecuted by the Yuma County Attorney’s Office.

3. I believe I am the victim of a criminal offense. How do I report the offense?: The Prosecutor’s Office is not an investigatory agency. The San Luis Police Department investigates criminal offenses in the City of San Luis. You should report all suspected criminal activity to the San Luis Police Department at 1030 Union St, San Luis, AZ 85349 or the police department's non-emergency number at 928-341-2420. In the event of an emergency or a life threatening situation, call 9-1-1.

4. I want to continue a court date. How do I do that?: Only the Municipal Court can grant a continuance. You must file an appropriate motion with the Municipal Court. 6. Can I park my motor home in my driveway?

City ordinances allow you to park recreational vehicles (boats, campers, trailers, etc.) that are 20 feet long or less in your driveway, on a paved surface adjacent to the driveway in the side yard, or on a paved surface in the rear yard. You may also be subject to recorded covenants which limit this type of storage; however, the City does not enforce covenants.

The City of San Luis has an ordinance prohibiting the parking on any lot in any residential or business district any vehicle which is inoperable and is characterized by dents, breaks, cracking, peeling, rusting or lack of maintenance. For questions about this, or ordinances regarding real property, contact the City of San Luis Planning and Zoning Department.

7. Can the City tow my car out of my driveway?

All vehicles (car, trailer, etc.) must be properly licensed, operable and parked on a paved surface. If any of these requirements are not met, residents will be given notice of the violations and 10 days to cure the defects. If the defects are not cured, the vehicle may be towed at the owner's expense.

If your vehicle has been towed by a private tow company from private property you will have to contact the tow company directly. They are not required to give prior notice before towing.

8. Do I have to license my cat or dog?: All cats and dogs must be licensed annually. If you own four or more dogs, you must apply for a kennel license.

9. How do I press charges against another person?: A private person cannot press charges against another person. Only the police or the prosecutor can bring criminal charges against another person. If you wish to lodge a criminal complaint about someone, call the San Luis Police Department at 928-341-2420.

10. Can I drop the charges?: No. The City of San Luis, through the police department or the City Prosecutor, not you, has charged the defendant with a crime. Although the decision to prosecute or dismiss a case is made by this office, we do consider the wishes of victims when making that decision.

11. Will I have to testify?: If you are a victim or a witness of a crime, you may have to testify at trial. However, most cases are settled without trial.

12. How do I clear up a bench warrant?: Contact the San Luis Municipal Court and speak with a clerk.

14. What is a Plea Agreement and how do I get one?: A Plea Agreement is a written contract between the defendant, with the advice of an attorney or acting alone, and the prosecutor by which an agreement is reached regarding disposition of the charges in a case. Plea agreements may include dismissal of some charges in exchange for a plea of guilty to other charges; or it may be that the defendant and the prosecutor agree on a particular sentence in a case.

15. I received a citation, but can't make my court appearance date. What can I do?: If you have received a citation and can't make your court appearance date, contact the San Luis Municipal Court at 928-341-8595 for information.

16. Can I discuss my case with the Prosecutor?: The City Prosecutor may discuss your case with you as long as you are not represented by an attorney. If you are represented by an attorney, the Prosecutor can speak only to your attorney.
